By accessing this website, browsing content, placing an order, or using any SurvivorCBD product, you knowingly, voluntarily, and irrevocably agree to be bound by these Terms and Conditions. If you do not agree, you must immediately discontinue use of the website and refrain from purchasing any products.

1. ELIGIBILITY AND LEGAL CAPACITY
   You must be at least 18 years of age and legally capable of entering binding contracts. You affirm that all information you provide is accurate, truthful, and complete. Any use by minors or unauthorized parties is strictly prohibited.
   
   
2. PRODUCT STATUS, REGULATORY POSITION, AND FDA DISCLAIMER
   SurvivorCBD products are consumer wellness products derived from hemp. SurvivorCBD products are not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition. Statements on this website have not been evaluated by the United States Food and Drug Administration. No representations made by SurvivorCBD LLC constitute medical, therapeutic, or health guarantees.
   
3. NO MEDICAL, MENTAL HEALTH, OR LEGAL ADVICE
   All content provided is for informational and educational purposes only. Nothing on this website constitutes medical advice, mental health advice, legal advice, or professional guidance. You agree that you alone are responsible for consulting licensed professionals regarding health, mental health, or legal matters.
   
   
4. ASSUMPTION OF ALL RISKS
   You expressly acknowledge that the purchase, possession, and use of cannabinoid products involves inherent, known, and unknown risks. You voluntarily and knowingly assume all risks associated with use, misuse, ingestion, topical application, storage, reliance, or distribution of SurvivorCBD products. SurvivorCBD LLC makes no representations regarding effects, outcomes, or results.
   
   
5. PERSONAL RESPONSIBILITY, RELEASE, AND WAIVER
   You accept full responsibility for product selection, dosage, frequency, method of use, and personal outcomes. You hereby irrevocably release, waive, and discharge SurvivorCBD LLC from any and all claims, demands, damages, injuries, losses, liabilities, or causes of action arising from or related to product use or website access. This release applies to claims known or unknown, suspected or unsuspected.
   
   
6. CALIFORNIA CIVIL CODE 1542 WAIVER
   You expressly waive the protections of California Civil Code Section 1542, which states that a general release does not extend to claims which the releasing party does not know or suspect to exist at the time of executing the release. You acknowledge that you may later discover facts different from those now known, and you nevertheless release SurvivorCBD LLC from all claims.
   
   
7. LEGAL COMPLIANCE AND JURISDICTIONAL RESPONSIBILITY
   SurvivorCBD products are intended to comply with applicable United States federal and California state laws. You are solely responsible for determining legality in your jurisdiction. SurvivorCBD LLC bears no responsibility for products delayed, seized, restricted, prohibited, or penalized under local, state, or federal law.
   
   
8. UNITED STATES SALES ONLY
   SurvivorCBD LLC sells and ships products within the United States only. Any attempt to export, resell internationally, or redirect shipments is prohibited.
   
   
9. ORDERS, PAYMENT, AND ABSOLUTE RIGHT TO REFUSE SERVICE
   All prices are listed in United States dollars. SurvivorCBD LLC reserves the absolute and unrestricted right to refuse service, cancel orders, limit quantities, terminate accounts, or block transactions at its sole discretion. This includes suspected fraud, abuse, chargeback activity, or violations of these Terms.
   
   
10. CHARGEBACK ABUSE AND FRAUD PROTECTION
    Initiating a chargeback without first contacting SurvivorCBD LLC constitutes abuse. SurvivorCBD LLC reserves the right to contest chargebacks, submit evidence, suspend accounts, and recover costs associated with fraudulent disputes. You agree to be liable for any fees, penalties, or damages arising from chargeback abuse.
    
    
11. SHIPPING, DELIVERY, AND RISK OF LOSS
    Shipping timelines are estimates only and not guaranteed. Risk of loss, theft, damage, or delay transfers to you immediately upon shipment to the carrier. SurvivorCBD LLC has no liability for carrier performance, delivery failures, or third party handling.
    
    
12. FINAL SALE POLICY
    All sales are final. No returns, exchanges, or refunds are permitted once an order has shipped. Any exception for damaged or defective products is solely at the discretion of SurvivorCBD LLC and must be reported within seven days of delivery.
    
    
13. SUBSCRIPTIONS AND AUTOMATIC BILLING AUTHORIZATION
    If subscription or recurring purchase options are offered, you expressly authorize automatic recurring charges. You are solely responsible for managing, modifying, or canceling subscriptions before billing. Failure to cancel does not entitle you to refunds, reversals, or charge disputes.
    
    
14. FORCE MAJEURE
    SurvivorCBD LLC shall not be liable for delays or failures caused by events beyond its reasonable control. This includes natural disasters, acts of war, labor disputes, carrier disruptions, governmental actions, pandemics, or system failures.
    
    
15. INTELLECTUAL PROPERTY OWNERSHIP
    All content, trademarks, trade dress, formulations, designs, text, graphics, images, and website materials are the exclusive property of SurvivorCBD LLC. Unauthorized use, reproduction, or distribution is strictly prohibited and will result in legal action.
    
    
16. PROHIBITED CONDUCT
    You agree not to misuse products, misrepresent claims, resell without authorization, violate laws, or interfere with website operations. SurvivorCBD LLC may terminate access and pursue legal remedies for violations.
    
    
17. MAXIMUM LIMITATION OF LIABILITY
    To the fullest extent permitted by law, SurvivorCBD LLC shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages. Total liability shall be strictly limited to the amount paid for the product giving rise to the claim. You expressly waive any right to a jury trial and any right to seek or obtain injunctive or equitable relief against SurvivorCBD LLC.
    
    
18. INDEMNIFICATION AND DEFENSE
    You agree to fully indemnify, defend, and hold harmless SurvivorCBD LLC, its owners, officers, employees, agents, and contractors from all claims, liabilities, damages, losses, costs, and expenses arising from your use of the website or products. This obligation survives termination.
    
    
19. DISCLAIMER OF WARRANTIES
    All products and services are provided as is and as available. SurvivorCBD LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non infringement.
    
    
20. THIRD PARTY CONTENT AND LINKS
    SurvivorCBD LLC is not responsible for third party websites, content, products, or services. Access to third party resources is at your own risk.
    
    
21. BINDING ARBITRATION, VENUE, AND CLASS ACTION WAIVER
    You expressly waive any right to a jury trial and any right to seek or obtain injunctive or equitable relief against SurvivorCBD LLC.
    Any dispute shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in California. You waive the right to a jury trial and any class, collective, or representative action.
    
    
22. ELECTRONIC COMMUNICATIONS CONSENT
    You consent to receive all communications electronically, including notices, disclosures, and agreements. Electronic communications satisfy all legal notice requirements.
    
    
23. GOVERNING LAW AND EXCLUSIVE VENUE
    These Terms are governed by the laws of the State of California. Any matter not subject to arbitration shall be brought exclusively in California courts.
    
    
24. SEVERABILITY AND SURVIVAL
    If any provision is found unenforceable, the remaining provisions remain in full force and effect. All provisions intended to survive shall survive termination.
    
    
25. MODIFICATIONS AND ENFORCEMENT
    SurvivorCBD LLC may modify these Terms at any time without notice. Continued use constitutes binding acceptance of all revisions.
    
    
26. ENTIRE AGREEMENT
    These Terms constitute the entire agreement between you and SurvivorCBD LLC and supersede all prior communications.
